A probationer, Jose Elias Aguilar, was charged for capital murder and carjacking in Pico Rivera where a 13-year old girl died, and her 8-year old brother was seriously injured.

Aguilar, 26, is schedule for court August 19 at the Norwalk courthouse for murder, corporal injury to a minor, four counts of carjacking, and kidnapping during the act of carjacking.

The suspect got into a parked van where victims, Isabella Cortes and her three siblings- ages 17, 13, 11, and 8- were waiting for their parents as they went inside to buy food. Aguilar allegedly yelled at the children to exit the vehicle, but the suspect drove off at high speed with them still inside. The van’s sliding doors began to open moments after and all 4 jumped out the vehicle seconds apart. The 18-year old female fought the suspect and later jumped out the van followed by her 11-year old brother who suffered minor injuries. The 8-year old girl was forcefully ejected from the van with minor injuries. Isabella Cortes, 13, was forcefully ejected and struck an object which sustained fatal injuries at the scene.

Aguilar struck a vehicle and attempted to carjack another vehicle but failed and allegedly attempted to run back to the disabled van. Several street vendors nearby detained the suspect until authorities arrived. He was taken to the hospital for minor injuries and was later booked on suspicion of murder, carjacking, and kidnapping.

Prosecutors are still deciding on the death penalty to be used against him.
